We can see you at short notice, since often an employer will ask that the compromise agreement be signed within a limited period of time. If necessary we will do our best to see you outside office hours, including at weekends if we can.
We give free compromise agreement advice
To enter into a valid compromise agreement, the employee must receive advice about the agreement and its effect from an appropriate adviser. A solicitor is an appropriate adviser. We have advised many employees during the last few years in relation to compromise agreements. One provision of a compromise agreement is that the employer will contribute a certain amount towards the employee’s costs in obtaining advice. We make a point of always limiting our costs to no more than the amount contributed by the employer, so you do not have to pay anything.
What is a compromise agreement?
A compromise agreement is an agreement between an employee and an employer which is intended to bring to an end the employee’s employment on certain terms.
A compromise agreement can be used to settle a dispute between an employer and employee and it can also, for example, be used where the employer is proposing to make redundancies. It provides for the employer to pay the employee a sum of money in return for which the employee agrees that their employment will terminate on a specific date and they will not pursue any claim against the employer arising out of their employment or the termination of this.
Each compromise agreement is specific to the individual employee. Some of the terms of an agreement will, however, be standard to all compromise agreements. There is a considerable amount of employment law legislation and the compromise agreement will set out the specific claims which the employee will be prevented from pursuing against the employer by having signed the agreement. An employee does not have to enter into a compromise agreement, but it may be that the employee will consider it advantageous to do so, particularly if the employer is offering a payment under the agreement which is more than it might otherwise have to pay as a matter of law.
